Collecting your Personal Information
Breakfree will collect personal information such as your name and email address so that we may contact you regarding our products and services. Breakfree may also collect other personal information including health and medical data so that we may safely and effectively provide you with any products, programs and services that you have purchased or elected to receive.
If you have registered for the Food and Weight Freedom program you will need to provide information via an online survey such as your full home address, date of birth, gender, physical measurements, and other more detailed information about your lifestyle (including but not limited to: employment, preferences, habits, personal routines) and your health and medical history in order for us to assess and create a tailored program to help you meet your health, nutrition and lifestyle goals.
Using your Personal Information
Breakfree will use your personal information to inform you of our products and services and to deliver any products, services or programs that you have purchased or elected to receive. We may also contact you to invite you to participate in a survey we may be conducting.
Breakfree uses other service providers to provide services on our behalf. These include the processing and delivery of emails; processing credit card transactions; collecting and analyzing survey data; providing web-based coaching services; database management; and scheduling appointments. These other businesses are required to maintain the confidentiality of your personal information. These third parties are prohibited from using your personally identifiable information for any other purpose. Breakfree does not share any information with third parties for any unknown or unrelated uses.
Some of the service providers we use are located outside of Australia. Please note that personal information in the custody of these service providers may be subject to access by the law enforcement authorities of those jurisdictions in which the service providers are located.
Our Privacy Officer, whose contact information is provided below, can provide further information about our policies and practices regarding service providers located outside of Australia and further information about how these service providers, collect, use, disclose or store personal information on our behalf.
We engage the services of MailChimp and ConvertKit to deliver emails. We only ask for your first name and email address when you sign up to our mailing list.
We engage the services of ProProfs and JotForm to help us collect other information about you that we need to effectively deliver our services and manage our programs.
We engage the services of Acuity Scheduling to enable our clients to schedule appointments with us online.
We engage the services of Trello, Zoom, Signal and MealLogger to help us communicate with our clients.
We engage the Services of Precision Nutrition to help us deliver web-based coaching services via the Pro-Coach Platform.
Your health and personal information may also be used to help analyse the effectiveness of any services or programs that Breakfree is providing to you. Your information will be deidentified and only aggregate data will be used for reporting. Your personal information will not be identifiable.
We also collect information that may or may not include your personal information, through technology and tools that tell us when a computer or device has visited or accessed our content. Those tools include services from Facebook and Google that help us to tailor our content, products and services to better suit consumers and customers. Search engines provide facilities to allow you to indicate your preferences in relation to the use of those tools in connection with computers and other devices controlled or used by you.
Controlling and Accessing Your Personal Information
If your personally identifiable information changes, or if you no longer desire our service, you may correct or update it by contacting us.
You may elect to stop receiving promotional emails from Breakfree by simply following the unsubscribe link at the bottom of an email or by notifying us directly.
You may arrange to access your personal information by contacting us.
We do not impose any charge for a request for access, but we may charge you a reasonable fee for our costs associated with providing you with access and retrieval costs.
Securing your Personal Information
The security of your personal information is important to us. We take all reasonable precautions to ensure that your personal information is kept safe from loss, unauthorized access, modification or disclosure. Among the steps taken to protect your information are:
- premises security;
- restricted file access to personal information;
- deploying technological safeguards such as security software and server firewalls to prevent hacking or unauthorized computer access;
- internal password and security policies; and
- secure socket layer technology (SSL).
When you enter sensitive information (such as credit card numbers) on our website, we encrypt that information using SSL. When Credit Card details are collected, we simply pass them on in order to be processed as required. We never store Credit Card details. We follow generally accepted industry standards to protect the personal information submitted to us, both during transmission and once we receive it.
Breakfree uses Thrive Cart and Stripe for its online credit card transactions. Stripe processes millions of dollars of online credit card transactions for merchants all over the globe and provides a safe and secure means of collecting payments via the Internet.
- Payments are PCI-compliant
- No transaction data is stored on our servers.
- All transactions are performed under 128 Bit SSL Certificate.
- All transaction data is encrypted for storage within Stripe's bank-grade data centre.
You should be aware that sending personal information via regular email may not be entirely secure. If you prefer to keep communications completely private, do not use regular email. If you elect to send or receive personal information, results or reports via unsecured email, Breakfree will not be liable for any security breach.
Disclosing your Personal Information
Breakfree will never share, rent, lease or sell your personal details to your employer, private health insurer or any other third party (other than our approved service providers as described above) without your consent.
Under certain circumstances, Breakfree may be required by law to disclose personal information (e.g. court orders, subpoenas, search warrants). Breakfree also reserves the right to disclose personal information in order to protect the rights, property or safety of Breakfree, its employees, clients or others.
To provide you with a safe, personalised and effective program or service it may be necessary for Breakfree to contact your doctor or other health care provider. However, we will always obtain your consent before doing so. In the event that you do not provide this consent, Breakfree may be unable to provide the program or service.
In the event that Breakfree is purchased by or merged with another business, Breakfree reserves the right to transfer clients' personal information to the new trading entity. This new entity will also be required to comply with the terms of this policy.
